Terms of Service

These Terms of Service ("Terms") govern your use of the GamePulse application and website at www.gamepulse.com.au (the "Service"), operated by GamePulse ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and use the Service. By creating an account, you represent that you meet this requirement.

If you are using the Service on behalf of a sports club or organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate and complete information when creating your account
  • Keep your login credentials secure and not share them with others
  • Notify us immediately of any unauthorised use of your account
  • Accept responsibility for all activity on your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Upload or transmit content that is offensive, defamatory, or infringes on the rights of others
  • Attempt to gain unauthorised access to any part of the Service or its systems
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use automated means (bots, scrapers, etc.) to access the Service without our prior written consent
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Enter false or misleading information about players, games, or clubs

4. Your Content

You retain ownership of all content you submit to the Service, including club information, team data, game statistics, player information, photos, logos, and feedback ("Your Content").

By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free licence to use, store, display, and process Your Content solely for the purpose of providing and improving the Service. This licence ends when you delete Your Content or your account, except where Your Content has been shared with others who have not deleted it, or where retention is required by law.

You represent that you have the right to submit Your Content and that it does not violate any third party's rights. If you enter personal information about other individuals (such as player names), you represent that you have the appropriate authority or consent to do so.

5. Club and Team Management

Club administrators are responsible for managing access to their club's data, including inviting and removing members, assigning roles, and ensuring that team and player information is accurate and appropriately managed.

We are not responsible for disputes between club members regarding access, roles, or data management within the Service.

6. AI-Generated Content

The Service may provide AI-powered analysis and insights based on game statistics. This content is generated automatically and is provided for informational purposes only. We do not guarantee the accuracy, completeness, or usefulness of AI-generated content, and it should not be relied upon as the sole basis for coaching or strategic decisions.

7. Intellectual Property

The Service, including its design, features, code, and branding (excluding Your Content), is owned by GamePulse and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code of the Service.

8. Availability and Changes

We strive to keep the Service available at all times, but we do not guarantee uninterrupted or error-free operation. We may:

  • Modify, suspend, or discontinue any part of the Service at any time
  • Perform maintenance that may temporarily affect availability
  • Update these Terms, with notice provided via the Service or email

Your continued use of the Service after changes to these Terms constitutes acceptance of the updated Terms.

9. Fees and Payment

GamePulse offers the following subscription plans:

  • Team Plan: per-team monthly subscription
  • Team Bundle: monthly bundle for larger clubs
  • Player Tracking: currently available free of charge

Current pricing is shown in the App Store purchase sheet or checkout before you subscribe. Final pricing may vary by country, storefront, taxes, and Apple exchange-rate settings.

Free Plan

Team tracking includes access to dashboards, games, stats, and live tracking for the first quarter of each game. A team subscription is required to track beyond the first quarter. Player-owned tracking, dashboards, stats, and analytics are currently available free of charge. We may introduce player plans later with notice.

Free Trial

Subscriptions may include a 14-day free trial for full-game tracking and premium analysis features. A valid payment method is required to start a trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.

Billing

Payments are processed by the App Store or our checkout provider, depending on where you subscribe. Subscription management is handled by RevenueCat. By subscribing, you agree to the applicable payment provider's terms of service and privacy policies.

Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of your paid period.

Refunds

Refund requests are handled on a case-by-case basis. Please contact us at support@gamepulse.com.au for any billing enquiries.

Price Changes

We reserve the right to change our pricing at any time. If we change the price of a subscription, we will provide you with at least 30 days' notice before the new price takes effect. Your continued use of the Service after a price change constitutes acceptance of the new price.

10. Limitation of Liability

To the maximum extent permitted by Australian law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability for any claim arising from or related to the Service shall not exceed the amount you have paid us in the 12 months preceding the claim, or AUD $100, whichever is greater.
  • We are not liable for any loss of data, including game statistics, player information, or club data, although we take reasonable steps to protect against data loss.

Nothing in these Terms excludes or limits any consumer guarantees under the Australian Consumer Law that cannot be excluded or limited by law.

11. Indemnification

You agree to indemnify and hold harmless GamePulse and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at our discretion, with or without cause, and with or without notice.

Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination (including ownership, warranty disclaimers, indemnity, and limitations of liability) will continue to apply.

13. Dispute Resolution

If a dispute arises, we encourage you to contact us first at support@gamepulse.com.au so we can attempt to resolve it informally.

If we cannot resolve the dispute informally, it will be governed by and construed in accordance with the laws of the State of New South Wales, Australia, and you submit to the exclusive jurisdiction of the courts of Victoria.

14. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia, without regard to its conflict of laws provisions.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
